Welcome to PhotoPick Photography. By using this website, you signify your acceptance of these terms and conditions of use. For the purposes of these terms and conditions, “Us”, “Our”, “We” and “Photographer” refers to PhotoPick Photography and “You” and “Your” refers to you, the client, visitor or person using our website.
You agree to receive notification regarding your order by email, SMS or phone.
Where photography has been commissioned or not; the client agree that copyright is retained by the Photographer unless otherwise agreed in writing, however we grant to the client a royalty-free, non-exclusive perpetual licence to use the images for non-commercial use. The images must not be resold in any format without permission from the Photographer. PhotoPick Photography may use/display selected images on our website, social media sites, literature, exhibitions, competitions and promotional activities. Should the client not wish to have their photos or videos uploaded to the internet for viewing or sample placed on Photopick Photography website, or used in marketing materials, a fee amount of 30% from total price of chosen Package will apply.
Rates and prices
Rates and prices quoted on our website are subject to availability and can be withdrawn or changed without notice. The price and availability is only guaranteed when booking deposit payment has been received by us. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. Photoshoot packages on our website have been quoted on the basis of the package type, session time frame, number of photos and props. All prices are in Australian dollars.
Every Photoshoot package includes a certain number of images. If you require extra images, an additional cost of $25 per image will apply, payment must be received in full before the images are edited or retouched.
If for any reason the work commissioned takes longer the time originally anticipated at the date of the booking, you will be charged additionally $120 per hour. Photographer will notify the client before the start of the overtime shooting. All additional costs such as permits to enter national parks, beaches that require permits, if any, are the responsibility of and must be paid for by the client.
Bookings and payments
You may book your photoshoot on our website, over phone or by email. On making a booking the client is required to pay a minimum of $50 deposit for all bookings within 5 days of your photoshoot order date to secure your booking, otherwise your bookings may be automatically cancelled. Remaining balance is due on the day of the photoshoot (cash only on the day) or direct bank transfer one week prior to the photoshoot date.
Cancellation and refunds
Once the client has made a booking for a specific time and date, PhotoPick Photography will not accept any other work from other clients for those times and dates. As a result, if a booking is postponed more than once or cancelled, we reserve the right to charge the client a cancellation fee of $50 plus any additional costs such as purchased permits to enter national parks, beaches that require permits or travel tickets, if any, are the responsibility of and must be paid for by the client.
If the Photographer could not perform the work due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, then the Photographer shall return any moneys paid by the Client (including Deposit). This limitation of liability shall also apply in the event that photographic materials are damaged, lost through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without the fault on the part of the Photographer.
Client is allowed to postpone booked photoshoot once with more than 72 hours notice without accruing cancellation fees. In the event of the photoshoot being postponed, the deposit will be retained until the event is rescheduled. If the event is not rescheduled, cancellation fees as above will apply. If the Client requested to reschedule booked photoshoot, there might be additional costs such as purchased permits to enter national parks, beaches that require permits or travel tickets, if any, are the responsibility of and must be paid for by the client.
Online Gallery and Post Processing of images
Proofing Date: – Date we will upload your images on our website under Proofing section, online galleries will be uploaded within 5 working days of the photoshoot date. Clients to make their selections within 7 working days from the notification date to choose images for editing and retouching. Once you make your selection and passed the selection period of 7 working days, your selections are irreversible.
Failure to make your selections within that time frame, will result delays in processing your order. In the event where the Client didn’t contact us to make their selection within 30 days from the Proofing date, the Client order will be deferred and Photographer solely will select images for editing and retouching and finalize the order for the Client. If the Client not satisfied with Photographer selections, and require other photos to be edited, Client will be charged additional $25 per image, payment must be received in full before the images are edited or retouched.
Note: All Proofs will be in low resolutions and unedited images as they are not the final product, Proofs are not allowed to be posted online.
Your order will be finalized within 14 working days from the day you have made your online galleries selection. Once your order is ready, you will be notified with a link (URL) to download your final edited high-resolution JPEG files. All download links will expire after 14 days from the release date. If Client request access to download links after the expiry date, Client will be charged upload fees of $20 per photoshoot package.
Overall appearance and client`s participation
The Photographer cannot be held responsible for outfit choices made by the Client, co-operation on the day or family member’s refusal to participate, nor responsibility for any missing, damaged or altered clothing/material belonging to the Client. It is the Client responsibility to make sure their clothes, makeup, hair and overall appearance are the way they want for the photos, the photographer does not bare any responsibility for any styling, makeup issues, hair problems or any other factors in the photography other than the directing and photography of the Client.
All gift vouchers are non-refundable and cannot be redeemed for cash and it must be used before the expiry date. Personalized text line is chosen by the Client. Gift Vouchers are posted to Australian mailing address provided by the Client after payment is received in full.
Loss or Damage
Elements that are beyond our control include faulty material, equipment failure or damage or loss of digital files. In this case, Photographer and the client agree that the liability of the Photography shall be limited to a full or partial refund of any money paid under this agreement, which shall be in full & final satisfaction of any damage or loss suffered.
Every effort will be made to capture as many moments of your event as humanly possible however it is not possible to capture absolutely everything. If you have suggestions or desires for photos to be captured, please write them down on a list for me and I will do my best to get them. Because of the ever-changing nature of event day, not everything can be covered. We are not responsible for a missing family member(s) during the event photo session.
Errors, inaccuracies and omissions
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
Amendment of terms
You can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
